Collections Attorney

Here at A&E Real Estate we are seeking a skilled and motivated Collections Attorney to join our legal team.
As a Collections Attorney, you will play a crucial role in managing our collections process and ensuring the timely recovery of outstanding debts.
Your primary responsibility will be to handle legal matters related to debt collection, providing expert legal advice, and representing our company in court when necessary.
Responsibilities1.
Legal Representation:
Represent the company in legal proceedings related to debt collection, including court appearances, hearings, and negotiations with opposing parties.
2.
Debt Recovery:
Develop and implement effective strategies for the collection of outstanding debts, utilizing legal tools and resources to maximize recovery rates.
3.
Legal Compliance:
Ensure compliance with all relevant laws, regulations, and industry standards pertaining to debt collection practices, including the Fair Debt Collection Practices Act (FDCPA) and other applicable consumer protection laws.
4.
Case Management:
Manage a caseload of collection matters, including reviewing and evaluating cases, conducting legal research, drafting legal documents, and maintaining accurate and up-to-date case files.
5.
Negotiation:
Negotiate settlements and payment arrangements with debtors, aiming to reach mutually beneficial outcomes while protecting the company's interests.
6.
Legal Advice:
Provide expert legal advice and guidance to internal stakeholders, including management, collections teams, and other departments, regarding debt collection strategies, legal risks, and compliance issues.
7.
Documentation:
Prepare and review legal documents, such as demand letters, complaints, summonses, motions, and affidavits, ensuring accuracy, adherence to legal requirements, and effective communication of the company's position.
8.
Legal Research:
Stay updated on relevant legal developments, industry trends, and best practices in debt collection law, and apply this knowledge to enhance our collections strategies and legal approach.
9.
Relationship Management:
Collaborate and maintain relationships with external & internal legal partners, including outside counsel, internal legal team, the portfolio teams, India team, courts, and regulatory authorities, ensuring effective communication and cooperation.
1.
Juris Doctor (J.
D.
) degree from an accredited law school and active membership in the bar association of the relevant jurisdiction.
2.
Proven experience as a Collections Attorney or similar role, preferably in a corporate legal department or a law firm specializing in debt collection.
3.
Strong knowledge of debt collection laws and regulations, including the FDCPA, and a track record of ensuring compliance with legal requirements.
4.
Excellent litigation skills, including experience in representing clients in court, conducting legal research, and drafting legal documents.
5.
Exceptional negotiation and communication skills, with the ability to effectively interact with debtors, clients, and other stakeholders.
6.
Detail-oriented with excellent organizational and time management abilities to handle a high caseload and meet deadlines.
7.
Ability to work independently and as part of a team, demonstrating a proactive and results-driven mindset.
8.
Proficiency in legal research tools, case management software, and MS Office Suite.

The check can be for multiple reasons such as signing bonus, supplies, etc. The victim will be instructed to deposit the check and use the money for any of these reasons and then instructed to send the remaining funds to the fraudster. The check will bounce and the victim is left responsible.
